Terms of Use and Registration of Radiation Measurement Metadata

    (Purpose)
Article 1.  These Terms of Use shall apply to the Registration and Use of the Radiation and Radioactivity Metadata Base provided by the Working Group for Radiation and Radioactivity Measurement Data Archives, Institute for Space-Earth Environment Research, Tokai National Higher Education and Research System Nagoya University (hereinafter referred to as "the Group"). (hereinafter referred to as the " Meta-database ") provided by the Working Group on Radiation and Radioactivity Data Archives, Nagoya University Institute of Space and Earth Environment, Tokai National University Organization (hereinafter referred to as the "Group"). (hereinafter referred to as the "Meta-database") provided by the Working Group on Archives of Radiation Measurement Data (hereinafter referred to as the "Group").

    (Definitions)
  Article 2.  The term "registrant" shall mean a person who registers metadata information related to radiation measurements, etc. in this Meta-database, and the term "user" shall mean a person who uses information posted in this Meta-database.

    (Attribution of Rights)
Article 3.  The copyright and other rights to the information registered by a registrant and published in this Meta-database shall belong to the registrant itself, and the copyright and other rights to other content shall belong to the Tokai National University Organization Nagoya University (hereinafter referred to as "Nagoya University"). The copyright and other rights for other content belong to Nagoya University (hereinafter referred to as "Nagoya University").

    (Registration of Information)
Article 4.  A registrant shall register metadata information, etc. in this Meta-database under its own will and responsibility. However, the following cases are excluded. When this group collects information that has already been published on a website, literature, etc. When the information has been provided to this group and the registration work has been requested by this group.

    (Decision on whether or not to publish information)
Article 5.  A registrant may decide whether or not to disclose metadata information that it has registered in this Meta-database to a third party. However, in principle, information that has already been made public on websites, literature, etc. shall be made public, while personal information and information that can be used to identify individuals shall be kept private, and the handling of such information shall be in accordance with the agreements in Articles 7 and 8.

    (Disclosure of Information)
Article 6.  This group shall release metadata information to the public that has been approved for release under the previous article. This Licensee shall not be responsible for the accuracy of the content of the original data identified by the metadata information registered in this Meta-database.

    (Modification and Deletion of Information, Suspension of Publication) Article 7.  This group and the registrant may modify the information registered in this Meta-database at any time. In the event that a problem arises with the information registered in Meta-database, such as questions being raised, the Group may delete the information or suspend its release without the consent of the registrant.

    (Handling of Personal Information)
Article 8.  The handling of personal information registered in this metabase shall be in accordance with the Personal Information Protection Rules of Tokai National Higher Education and Research System, in addition to the provisions of laws and regulations.

    (Handling of Personally Identifiable Information)
Article 9.  This group shall not disclose any information registered in this Meta-database by a registrant that can identify the registrant (hereinafter referred to as "personally identifiable information") without the registrant's consent. (hereinafter referred to as "Personally Identifiable Information") to a third party without the consent of the registrant. However, in the following cases, this group shall not be responsible for the identification of the registrant by a third party.

1. When a user has agreed in advance to disclose the information only to the relevant user in case of an inquiry from the user.
2. When the user is identified by information based on information already disclosed on websites, literature, etc.
3. In the event that the user has been identified based on registered information other than the user's identification information.

    (Prohibited matters for registrants)
Article 10.   A registrant shall not perform any of the following acts when registering information to this Meta-database.

1. Registering false information.
2. Infringing the copyrights, trademarks, privacy rights, name rights, portrait rights, honor rights, or any other rights of a third party
3. An act to provide information for commercial purposes using this Meta-database.
4. An act to interfere with the operation of this Meta-database.
5. An act to damage the reputation of Nagoya University.
6. An act that causes or may cause damage to the user or a third party.

    (Prohibited Items by Users)
Article 11.  A User shall not perform any of the following acts when using this Meta-database.

1. Using the information provided in this Meta-database for any purpose, means, or method that violates any law, government ordinance, ministerial ordinance, or any other law or ordinance.
2. Use the information for any purpose, means, or method that infringes the rights of others.
3. Use the information in a manner that is offensive to public order and morals.
4. Causing, or threatening to cause, damage to the registrant or any third party.
5. Use or provision of harmful programs such as computer viruses..

    (Compensation for damages)
Article 12.  In the event that any damage is caused to the Group or the User due to the Registrant's violation of these Terms, the Registrant shall compensate the Group or the User for such damage. In the event that any damage occurs to the Group or the Registered User due to a violation of the Terms by the Registered User, the Registered User shall compensate the Group or the Registered User for such damage.

    (Disclaimer)
Article 13.  The Group shall not be liable for any damage caused by the Registrant to the User or any third party, any damage caused by the User to the Registrant or any third party, or any damage incurred by the User or any third party due to the delay, interruption, or suspension of the provision of this Meta-databased service. The Group reserves the right to suspend or discontinue the operation of the Meta-database and to change all or part of the information contained in the Meta-database without prior notice.

    (Use of Links and Banners)
Article 14.  This Meta-database is link-free. However, if you wish to link to this website, you must post an image of http://radarc311.isee.nagoya-u.ac.jp or a banner on the website. The banner image must not be modified in any way.

    (Registration and Changes to the Terms of Use)
Article 15.  The Group reserves the right to change the contents of this Agreement without prior notice as necessary.

    (Agreement to the Terms)
Article 16.   When a registrant registers or accepts to register information in this MetDB, the registrant shall be deemed to have agreed to these Terms and Conditions. When a user uses this Meta-database, the user shall be deemed to have agreed to these terms and conditions.

    (Court of Jurisdiction)
Article 17.  Nagoya District Court shall be the exclusive court of first instance for any lawsuit related to this Agreement.
